These Terms of Use (“Terms”) govern your access to and use of The Stock Market website, platform, memberships, and all associated content, including but not limited to photographs, videos, graphics, concepts, collections, and written materials (“Content”).
By accessing, downloading, or using any Content from The Stock Market, you agree to be bound by these Terms in full.
If you do not agree, do not use the platform.
1. Licensing & Usage Rights
All Content provided by The Stock Market is licensed, not sold.
Your right to use Content is strictly limited by the membership tier you purchase and remains valid only while your membership is active and in good standing.
Personal Use License (Beginner Investor)
Permitted uses include:
Personal brand content
Portfolio mockups
Moodboards or inspiration
Non-commercial social content
Prohibited uses include:
Client work
Paid advertisements
Websites, sales pages, or funnels for businesses
Templates, digital products, or resale items
Commercial Use License (Day Trader)
Permitted uses include:
Client projects
Websites and branding assets
Social media marketing
Email campaigns
Digital products (excluding resale of images themselves)
Strictly Prohibited (All Memberships):
Reselling, redistributing, sublicensing, or sharing Content
Uploading Content to stock libraries, asset marketplaces, or design platforms
Offering Content as part of a downloadable or transferable asset
Using Content after cancellation or failed payment
Using Content outside the scope of your membership tier
2. Intellectual Property & Ownership
All Content remains the exclusive intellectual property of The Stock Market and its contributing creators.
You may not claim ownership, authorship, or creative credit for any Content.
You may not represent Content as your own original photography or creative work.
You may not copy, replicate, or intentionally recreate The Stock Market’s unique visual concepts, collections, or creative direction for competing platforms or services.
This includes — but is not limited to — recreating shoot concepts, themes, or collection structures in a way that would reasonably be considered derivative or competitive.
3. Attribution & Misrepresentation
You may not:
Present Content as work you personally created
Submit Content to awards, competitions, or publications as original work
Use Content in a way that falsely implies exclusive ownership or authorship
Any form of misrepresentation is considered a material breach of these Terms.
4. Membership Access & Termination
Memberships are billed on a recurring basis.
You may cancel at any time; however, no refunds are issued.
Upon cancellation or failed payment, all usage rights are immediately revoked.
Continued use of Content after cancellation constitutes copyright infringement.
We reserve the right to suspend or terminate accounts without notice if misuse or abuse is detected.
5. Enforcement, Legal Action & Costs
If you violate these Terms, we reserve the right to:
Immediately revoke access
Issue a takedown notice
Pursue legal action
You agree that you are financially responsible for all costs associated with enforcement, including but not limited to:
Legal fees
Court costs
Attorney fees
Damages and settlement costs
This applies whether action is taken informally or through litigation.
6. Limitation of Liability
The Stock Market is not liable for:
Loss of business, revenue, or profits
Misuse of Content by third parties
Creative interpretation of imagery by end users
Image quality may vary due to film grain, lighting conditions, or artistic direction. These characteristics are intentional and are not grounds for dispute or refund.
7. No Guarantees
We make no guarantees regarding:
Increased sales
Engagement metrics
Business outcomes
Content performance depends on many factors outside our control.
8. Modifications to Terms
We reserve the right to update these Terms at any time. Continued use of the platform constitutes acceptance of updated Terms.
9. Governing Law
These Terms are governed by the laws of the United States and the state in which The Stock Market is registered.
